The Ordinance on facilities handling substances hazardous to water (Verordnung über Anlagen zum Umgang mit wassergefährdenden Stoffen (AwSV)) has come into force. The AwSV replaces the previous legislative framework consisting of individual state (Länder) ordinances. This article examines the implications of the new regulations for facility operators in the chemical industry. Both the previous state ordinances and the new AwSV are based on the model ordinance on facilities prepared by the German Federal States' Working Group on Water, but some state ordinances deviated from this model in certain respects. The AwSV therefore contains some new or modified provisions that are also of relevance to the washing agent, cleaning agent, perfume and cosmetics indutries. In general, the status quo of existing facilities is protected. However, the competent authorities have the right to order technical retrofits. Furthern the organisational requirements of the AwSV are fully applicable for existing facilities. In particular, operators may be required to undertake action with regard to the facility documentation. The AwSV contains much more specific requirements in this regard. |
